SSRN Legal Studies Research Paper Series, Vol. 13, No. 2

​SSRN provides open access to faculty publications and research. The Legal Studies Research Paper Series highlights the latest work by faculty of the University of Louisville Brandeis School of Law.

The second issue of 2020 includes work by two law school professors. In Cooperative Principles and Fair Labor Standards, Professor Ariana Levinson and student Chad Eisenback argue that food cooperatives located in food deserts do not violate the Fair Labor Standards Act when the owners volunteer to work without compensation. In her second article in this issues, Professor Levinson teams up with Erin O'Hara O'Connor of Florida State University and Paige Marta Skiba of Vanderbilt University to examine a data set of hundreds of labor arbitration awards to illuminate how arbitrators consider authority external to the collective bargaining agreement when deciding labor grievances. Professor Mark Rothstein writes about issues related to the new Coronavirus pandemic, including flattening the curve and the role of public health in two separate articles in this issue. In Lawsuits of Last Resort, he works with Julia Irzyk to examine the limited legal solutions available to workers whose employers fail to provide adequate protections against SARS-CoV-2.
